The agreement
These Terms govern your use of the OnScreenGames website and engagement platform (the "Services") provided by OnScreenGames, an Xponent21 studio ("we", "us"). By creating an account or embedding a widget you agree to these Terms.
Your account
You are responsible for keeping your credentials secure and for everything that happens under your account. Don't share credentials, don't try to access another customer's data, and don't reverse-engineer the platform.
Acceptable use
- No collecting personal data from minors without parental consent.
- No spam, phishing, malware, or anything illegal under U.S. or Virginia law.
- No content that infringes IP, is defamatory, or violates privacy.
- Don't use the platform to operate gambling-for-money mechanics or unregistered sweepstakes.
Billing
Paid tiers are billed monthly in advance. You can cancel at any time from /app/billing. We don't refund partial months. We may change pricing with at least 30 days' notice via email and an in-app banner.
Custom pitch & game work
Custom builds are governed by a separate statement of work executed by both parties. Splash pages at /pitches/[slug] are illustrative and create no binding obligation until an SOW is signed.
Termination
You can delete your account at any time. We may suspend accounts that violate these Terms, abuse the platform, or present a security risk. On termination we will retain backups for up to 30 days, then permanently delete account data.
Liability
The Services are provided "as is." To the maximum extent permitted by law, our aggregate liability for any claim arising out of these Terms is limited to the fees you paid us in the 12 months preceding the claim. Nothing in these Terms limits liability that cannot be limited by law.
